The following General Terms and Conditions (GTC) apply to the provision of services by SOMI Academy GmbH to its customers. Unless otherwise agreed in writing, these GTC apply exclusively.

1. Registration and Billing

1.1 Please register online via our website. Your registration is binding and will be booked by us in the order in which it is received.

1.2 The prices listed in the online shop on the booking date apply. We generally invoice participation fees shortly after the start of the event or course, with payment due immediately. For e-learning courses, the fee is invoiced immediately after registration.

2. Scope of Services

2.1 Unless otherwise specified, the participation fees listed for in-person events include comprehensive course materials.

2.2 The participation fee for live online training includes comprehensive course materials and, where applicable, additional tools for a successful live online experience.

3. Discount Options

3.1 The various discount options we offer cannot be combined. This also applies to total prices that have already been discounted.

4. Your Cancellation Guarantee for Events and Courses*

4.1 Substitute

For in-person events, you may designate a substitute for the registered participant up to 7 days before the seminar date. There are no additional costs to you. Starting 6 days before the seminar date, SOMI Academy GmbH reserves the right to charge a €15.00 plus VAT processing fee per participant change. If a substitute is named for e-learning courses, there are no additional costs as long as the e-learning has not yet begun.

4.2 Rescheduling

You may rebook to a different event or course once. The following rebooking fees apply:

4.2.1 Rescheduling up to 4 weeks before the start of the event or course: none

4.2.2 Rescheduling 4 weeks or less before the start of the event or course: 10% of the participation fees (min. €50; max. €350) plus VAT

4.3 Cancellation

You may withdraw from the contract. Please note that we charge the following processing fees:

4.3.1 Cancellation up to 4 weeks before the start of the event or course: 10% of the participation fees (min. €50; max. €350) excluding VAT

4.3.2 Cancellation up to 2 weeks before the start of the event or course: 50% of the participation fee (min. €50; max. €350) excluding VAT.

4.3.3 Cancellation 7 days or less before the start of the event or course: the full participation fee plus VAT. This also applies if the registered participant does not show up. If a course in progress is canceled, the full participation fee is due.

4.3.4 Once you begin an e-learning course, we charge the full participation fee plus VAT.

*Courses are modular series of events with a fixed schedule for a group of participants.

5. Cancellation of Events

5.1 We reserve the right to cancel the event due to insufficient demand or a low number of participants, or for other important reasons beyond our control (e.g., sudden illness of the instructor, force majeure). Any participation fees you have already paid will, of course, be refunded to you.

5.2 Further liability and compensation claims arising from the cancellation or modification of the event and not involving injury to life, limb, or health are excluded, unless there is intent or gross negligence on our part. Please also note this regarding any hotel rooms, flights, or train tickets you have booked.

6. Reservation of the Right to Make Changes

6.1 We reserve the right to make necessary changes or deviations regarding content, methodology, and organization (e.g., due to changes in the law) before or during the event, provided that these do not significantly alter the value of the announced event for the participant. We are entitled to replace the scheduled speakers, if necessary (e.g., due to illness or accident), with other individuals equally qualified regarding the announced topic.

6.2 The documents provided as part of the continuing education program are prepared to the best of our knowledge and belief. Liability and warranty for the correctness, timeliness, completeness, and quality of the content are excluded.

7. Schedule Preview

7.1 Please note that dates starting in January 2026 are a preliminary schedule. You can register for these dates today. However, we reserve the right to revise the training content, duration, and, if necessary, the price for these dates.

8. Retention of Title and Use of Teaching Materials

8.1 We reserve unrestricted ownership of all deliveries of teaching materials until the customer has fully fulfilled all payment obligations. The transfer to third parties, public distribution, or making course documents or teaching materials available to the public is not permitted. In particular, the publication of audio or video data, digital presentations, or scripts on publicly accessible internet portals (sharing) is prohibited.

9. Photographs and Video Recordings

9.1 During events, photographs of participants may be taken as part of a photo log. These photo logs are made available only to event participants within the learning environment. If you do not consent to being photographed or to the upload of the photo log into the learning environment, please contact the trainer.

9.2 In some events, participants may also be photographed or videotaped. Please note that these recordings—and not the photo logs—may be used for promotional purposes by SOMI Academy GmbH. If the recordings are to be used for promotional purposes, we will obtain your consent separately prior to the event.

10. Cancellation Terms

The organizer and the participant have the right to terminate this contract at any time for good cause. The contract is concluded on the day the contract is signed. Cancellation Policy and Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the first distance learning material.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., letter or email). To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

11. Consequences of Cancellation*

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods (e.g., distance learning materials), whichever comes first. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period expires. You bear the direct costs of returning the goods.

12. Use of E-Learning Services

12.1 Each participant receives personal access from us. Use of the e-learning software is limited to this participant and to a specific period of time. Sharing the access data with third parties is not permitted.

13. Final Provisions

Should individual provisions of this contract be invalid or unenforceable, or become invalid or unenforceable after the conclusion of the contract, the validity of the remainder of the contract shall remain unaffected.

We do not participate in dispute resolution proceedings before a consumer arbitration board.

The place of jurisdiction is Mainz.
